This Waiver of Liability and Assumption of Risk Agreement ("Agreement") is entered into between the participant (“Participant”) and Lifecykel Pty Ltd, (“Lifecykel”) and Jason Gilbert including his related entities, representatives and assigns ("Facilitator").
By signing this Agreement and/or participating in the Lifecykel x Jason Gilbert Water Fast Challenge (“Challenge”), Participant agrees to the following:
I understand that my participation in the Challenge is voluntary, and I confirm that I am undertaking this Challenge by my own free will. I have not been coerced, required or mandated by Lifecykel or Jason Gilbert to participate.
I acknowledge that water fasting, caloric restriction, and the associated educational materials, guidance and community discussions provided during the challenge may involve physical, psychological and emotional risks, including but not limited to:
Dizziness, fatigue, weakness, or fainting
Electrolyte imbalance or dehydration
Headaches, nausea, or gastrointestinal discomfort
Pre-existing health condition flare-ups
Adverse reactions due to medication interactions or health conditions
I understand that water fasting is not appropriate for everyone, especially individuals who are pregnant or breastfeeding, underweight, have chronic illness, a history of disordered eating, or are on prescribed medications, or who have been advised by medical practitioners that it is not safe.
I confirm that I have consulted with a licensed medical professional before commencing this Challenge, and I am medically and mentally fit to participate.
I understand that Lifecykel and Jason Gilbert are not licensed medical practitioners or dietitians, and that all content shared through emails, videos, Facebook groups, or any other platform is informational and educational in nature only, and does not constitute medical advice or diagnosis. I further acknowledge that such information is provided to assist me to decide whether to participate but that the decision to do so is my responsibility based on my own medical advice.
To the fullest extent permitted by law, I release and hold harmless Lifecykel, Jason Gilbert, their respective affiliates, employees, contractors, and representatives from any and all liability, claims, demands, or causes of action for injuries or damages (including death) arising from or related to:
Participation in the Water Fast Challenge
The application of any content or guidance received through the Challenge
Use of any product (including Lifecykel Shilajit or extracts) during or after the Challenge
This includes liability that may arise from negligence, whether passive or active.
I agree to take full responsibility for my participation in the Challenge, including monitoring my own health and wellbeing. I understand that I may exit the Challenge at any time if I feel unwell or uncomfortable, and I acknowledge that Lifecykel and Jason Gilbert may terminate my participation in the Challenge at any time if they become concerned about my health and wellbeing or if they reasonably believe that I am in breach of the warranties set out below
I am responsible for listening to my body and monitoring my physical condition, staying hydrated, refeeding responsibly, and seeking professional medical support as needed. I undertake to take all reasonable steps required to enable to me to do so.
I represent and warrant to each of Lifecykel and Jason Gilbert that:
I am over the age of 18 years;
I am not aware of any reason why I should not participate in the Challenge, having regard to the matters set out in clause 3 or this clause 5;
I will comply with all reasonable requirements and directions of Lifecykel or Jason Gilbert in relation to the Challenge and the conduct of the Challenge.
I understand that I may voluntarily share testimonials, photos, or other user-generated content (UGC) during the Challenge. I grant Lifecykel and Jason Gilbert the right to use this content for educational, promotional, or commercial purposes in all media formats, unless I revoke this consent in writing. I acknowledge and agree that any material generated or shared by me will be prepared or circulated in good faith and will not be misleading or deceptive.
This Agreement shall be governed by and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law provisions.
This document constitutes the entire agreement between the parties. No oral representations, statements or inducements apart from this written agreement have been made.
BY PARTICIPATING IN THE CHALLENGE, I ACKNOWLEDGE THAT I HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THIS WAIVER.
